        2.    DUI Laws and Convict ions

            
Over the past six legislati ve general sessions , 15 bills have been passed relating to the operatio n of a motor vehicle while under the influenc e of alcohol or drugs. Some of the issues these bills addresse d include repeat offender s, off- highway vehicles , aircraft pilots, the ignition interloc k system, chemica l tests, juvenile s, and stiffer penaltie s.

            In the 1997 General Session, the followin g two bills passed:

             HB 55 - Alcohol and Drug Testing Fee - increase d the administ rative fee for driver license reinstate ment after an alcohol or drug related offense from $35 to $100. (Rep. Don E. Bush)

             HB 226 - Driver License Reinstat ement - repealed the maximu m cap on specifie d jail time, commun

ity service hours, and fine amounts , allowin g judges more discretio n in imposin g sentence s for convicti on of a DUI offense; and requires drug depende ncy assessm ent, educatio n, rehabilit ation, or treatmen t after a convicti on, and requires complet ion of treatmen t and payment of fines prior to driver license reinstate ment.
