2:00 p.m.     1.    Call to Order and Committee Business - Sen. Mont Evans, Senate Chair
        *    Approval of minutes of July 15, 1998 meeting

2:10 p.m.     2.    Legislative Audit - Inspection of School Construction (Report #98-04)
        The Legislative Auditor recently completed an audit on the inspection of public schools under construction.
        *    Presentation of Audit:
                Wayne L. Welsh, Legislative Auditor General
                Leslie Marks, Audit Supervisor
        *    Response to Audit:
                Scott W. Bean, State Superintendent of Public Instruction
        *    Status Report of School Building Inspection Ad Hoc Workgroup

2:50 p.m.     3.    Optional Forms of County Government
        The committee will review the optional forms currently in statute, gain insight of a currently implemented optional form, and also examine changes proposed by the Utah Association of Counties.
        *    Current Law: Robert Rees, Associate General Counsel
        *    Experience of an Implemented Optional Form of County Government:
                M. Lynn Lemon, County Executive, Cache County
        *    Proposed changes:
                Brent Gardner, Executive Director, Utah Association of Counties

3:40 p.m.     4.    Follow up - Private Property Rights
        In the June meeting, the committee was introduced to issues relating to private property rights. This discussion will focus on revising the statute to conform with the Utah Constitution and accommodate arbitration.

4:20 p.m.     5.    Subdivision Development
        Some subdivisions are being developed such that the new homeowners are to take on the responsible for common infrastructure such as roads, subsurface water drainage systems, etc. Sometimes after the developer has left, problems arise that are too difficult for the residents to handle. The residents then turn to the municipality or county for help. Does the city or county have any responsibility since they approved the subdivision or performed inspections? Should these types of issues be resolved in the courts? Are better notice requirements needed for home buyers? Could forming a special district resolve the problem? Could some statute change prevent future problems? Concerned citizens and others will explain their perspectives of the problem.
