4:20 p.m. 5. Subdivision Development
Some subdivisions are being developed such that the new homeowners are to take on
the responsible for common infrastructure such as roads, subsurface water drainage
systems, etc. Sometimes after the developer has left, problems arise that are too
difficult for the residents to handle. The residents then turn to the municipality or
county for help. Does the city or county have any responsibility since they approved the
subdivision or performed inspections? Should these types of issues be resolved in the
courts? Are better notice requirements needed for home buyers? Could forming a
special district resolve the problem? Could some statute change prevent future
problems? Concerned citizens and others will explain their perspectives of the problem.
* Current Law: Robert Rees, Associate General Counsel
* Examples of the problem:
Deborah Watson, concerned citizen
* Local government perspectives:
Brent Gardner, Utah Association of Counties
