Senator Michael Waddoups, Co-Chair, called the subcommittee to order at 2:12 p.m.
MOTION: Rep. Zolman moved to approve the minutes of January 30, 1998 as written.
The motion passed unanimously with Sen. Muhlstein, and Reps. Chard, Barth and Arent absent for
the vote.
MOTION: Rep. Bigelow moved to approved the minutes of January 28, 1998 as written.
The motion passed unanimously with Sen. Muhlstein, and Reps. Chard, Barth and Arent absent for
the vote.
Chief Justice Zimmerman introduced Justice Howe to the subcommittee.
Analyst Bill Dinehart gave the subcommittee a handout from Dave Lamb of the Attorney General's
office regarding the surpluses shown in some of the state agencies.
A status sheet of subcommittee action to date was handed out along with a list for future
subcommittee consideration.
MOTION: Rep. Zolman moved that the vote on the budget for C E M be put on the agenda for action on Friday, February 6.
The motion passed unanimously with Rep. Chard absent for the vote.
MOTION: Sen. Steiner moved that the Governor's Budget and Attorney General's Budget be placed on the agenda for Friday, February 6.
The motion failed. Sen. Waddoups, Muhlestein, Steiner and Reps. Barth and Arent voting in favor.
Voting in opposition Reps. Zolman, Curtis, Bryson, and Bigelow.
Analyst Bill Dinehart presented the proposed budget for Courts. Tab33, page 5-6, covers Judicial
Compensation. The subcommittee traditionally reviews the Commission recommendation for Judicial
salaries and formally recommends a salary level to the Executive Appropriations Committee.
Tab34, page 8, notes that with the new technologies that improved direct access to the original files
are available on the internet. The internet address for Utah courts WEB page is given.
The proposed budget listing financing and programs is shown on page 25, tab 37 as well as page 1,
tab 33.
Daniel J. Becker, Utah State Judiciary, presented the agency response. Assisting him were Fred
Jayne, and Richard Schwermer. Handouts were given the subcommittee showing the Courts Budget
Priorities for FY99, Court Technology, Utah Juvenile Court - State Supervision Program as of February
1998, and FY99 Lease Budget Overview. Mr. Becker address these handouts, with questions being
answered by all three members of the agency.
Ray Wahl, Juvenile Court Operations, was introduced by Mr. Becker.
Reference was made to Operations and Maintenance budget issue on page 21.
The Courts were asked to provide a breakdown of costs before and after the construction of the new
buildings that have been brought into service in the last few year.
The following intent language was requested from Mr. Becker:
"It is the intent of the Legislature that monies collected by the court from past due accounts
receivable may be used to offset costs directly related to the costs of collection. The balance of
money collected above the costs of collection shall be allocated on a prorated basis to the various
revenue types that generated the account receivable."
"It is the intent of the Legislature to have the Juvenile Justice Task Force study the issue of juvenile
court security during the 1998 interim and present its findings to the Executive Office, Criminal
Justice, and Legislature Appropriations Subcommittee and to the Interim Judiciary Committee and
make any recommendations."
MOTION: Rep. Bigelow moved that the subcommittee be adjourned.
The motion passed unanimously and the subcommittee adjourned at 3:50 p.m.
