AN ACT RELATING TO THE MUNICIPAL CODE; ELIMINATING A RESTRICTION

AGAINST MUNICIPAL COURT JUDGES HOLDING OTHER MUNICIPAL OFFICE OR

EMPLOYMENT.

This act affects sections of Utah Code Annotated 1953 as follows:

10-3-810, as last amended by Chapter 59, Laws of Utah 1990

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
10-3-810
is amended to read:

10-3-810. Additional powers and duties of elected officials in cities of the third class
14
and towns.

All cities of the third class and towns may by resolution prescribe additional duties, powers,
16
and responsibilities for any elected or appointed official which are not prohibited by any specific
17
statute except that the mayor may not serve as recorder and neither the mayor nor the recorder may
18
serve as treasurer. [A justice court judge may not hold any other municipal office or position of
19
employment with the municipality.]
