UTAH SEISMIC SAFETY COMMISSION ACT

             6      AN ACT RELATING TO BOARDS AND COMMISSIONS; MODIFYING THE MEMBERSHIP
             7      OF THE UTAH SEISMIC SAFETY COMMISSION; ESTABLISHING FUNDING
             8      PARAMETERS; AND MAKING TECHNICAL CORRECTIONS.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          63C-6-101, as last amended by Chapter 270, Laws of Utah 1999
             12          63C-6-102, as enacted by Chapter 136, Laws of Utah 1994
             13          63C-6-104, as enacted by Chapter 136, Laws of Utah 1994
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 63C-6-101 is amended to read:
             16           63C-6-101. Creation of commission -- Membership -- Appointment -- Vacancies.
             17          (1) There is created the Utah Seismic Safety Commission consisting of [13] 15 members,
             18      designated as follows:
             19          [(a) the commissioner of the Department of Public Safety;]
             20          [(b)] (a) the director of the Division of Comprehensive Emergency Management or his
             21      designee;
             22          [(c)] (b) the director of the Utah Geological Survey or his designee;
             23          [(d)] (c) the director of the University of Utah Seismograph Stations or his designee;
             24          [(e)] (d) the executive director of the Utah League of Cities and Towns or his designee;
             25          [(f)] (e) a representative from the Structural Engineers Association of Utah biannually
             26      selected by [the] its membership;
             27          [(g)] (f) the director of the Division of Facilities and Construction Management or his

             28      designee;
             29          [(h)] (g) the executive director of the Department of Transportation or his designee;
             30          [(i)] (h) the State Planning Coordinator or his designee;
             31          [(j)] (i) a representative from the American Institute of Architects, Utah Section;
             32          [(k)] (j) a representative from the American Society of Civil Engineers, Utah Section;
             33          [(l)] (k) a member of the House of Representatives appointed biannually by the speaker
             34      of the House; [and]
             35          [(m)] (l) a member of the Senate appointed biannually by the president of the Senate[.];
             36          (m) the commissioner of the Department of Insurance or his designee;
             37          (n) a representative from the Association of Contingency Planners, Utah Chapter,
             38      biannually selected by its membership; and
             39          (o) a representative from the American Public Works Association, Utah Chapter,
             40      biannually selected by its membership.
             41          (2) The commission shall annually select one of its members to serve as chair of the
             42      commission.
             43          (3) When a vacancy occurs in the membership for any reason, the replacement shall be
             44      appointed for the unexpired term.
             45          Section 2. Section 63C-6-102 is amended to read:
             46           63C-6-102. Meetings -- Duties -- Committees.
             47          (1) The commission shall meet at the call of the chair, but not less than once each quarter.
             48          (2) The commission shall:
             49          (a) review earthquake-related hazards and risks to the state of Utah and its inhabitants;
             50          (b) prepare recommendations to identify and mitigate these hazards and risks;
             51          (c) prioritize recommendations and present them to state and local government or other
             52      appropriate entities for adoption as policy or loss reduction strategies;
             53          (d) act as a source of information for individuals and groups concerned with earthquake
             54      safety and as a promoter of earthquake loss reduction measures;
             55          (e) prepare a strategic seismic planning document to be presented to the State and Local
             56      Interim Committee before the 1995 annual general session of the Legislature; and
             57          (f) periodically update the planning document and monitor progress toward achieving the
             58      goal of loss reduction.

             59          (3) The commission may:
             60          (a) divide into or create subcommittees as it determines necessary to carry out its duties
             61      under this section[.]; and
             62          (b) accept contributions from other private or public sources and seek grants or funding
             63      from the federal government for uses relating to seismic safety.
             64          Section 3. Section 63C-6-104 is amended to read:
             65           63C-6-104. Staffing and appropriated funds.
             66          (1) Staff support to the commission shall be provided by the Division of Comprehensive
             67      Emergency Management and the Utah Geological Survey.
             68          (2) General Fund monies not expended by the Utah Seismic Safety Commission during
             69      a fiscal year are nonlapsing except that any balance greater than $10,000 lapses to the General
             70      Fund.
