AN ACT RELATING TO THE UTAH TOMORROW STRATEGIC PLANNING COMMITTEE;

MODIFYING THE MEMBERSHIP AND DUTIES OF THE UTAH TOMORROW

COMMITTEE; AND MAKING TECHNICAL CHANGES.

This act affects sections of Utah Code Annotated 1953 as follows:

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
36-18-1
is amended to read:
15
36-18-1. Utah Tomorrow Strategic Planning Committee -- Membership -- Per diem
16
and expenses -- Powers and duties.

(1) There is created the Utah Tomorrow Strategic Planning Committee.
18
(2) The committee consists of:
19
(a) [13] 17 voting members appointed as follows:
20
(i) [three] five members from the House of Representatives, appointed by the speaker of
21
the House, no more than [two] three from the same party;
22
(ii) [three] five members from the Senate, appointed by the president of the Senate, no
23
more than [two] three from the same party;
24
(iii) the state court administrator or the administrator's designee; and
25
(iv) six members appointed by the governor after consultation with the president of the
26
Senate and the speaker of the House as follows:
27
(A) the state planning coordinator or the coordinator's designee; [and]
28
(B) a member who has expertise in the areas of government productivity, efficiency, and
29
customer service; and
30
[(B)] (C) [five] four members appointed from among the following:
31
(I) directors of state agencies or the directors' designees;
32
(II) elected officials of political subdivisions or the officials' designees;
33
(III) the governor's staff; and
34
(IV) the public at large; and
35
(b) additional nonvoting members designated by the committee.

(3) (a) Except as required by Subsection (b), as terms of current committee members
37
appointed under Subsections (2)(a)(iv) expire, the governor shall appoint each of these new
38
members or reappointed members to a four-year term.

(b) Notwithstanding the requirements of Subsection (a), the governor shall, at the time of
40
appointment or reappointment, adjust the length of terms to ensure that the terms of these
41
committee members are staggered so that approximately half of the committee membership under
42
Subsection (2)(a)(iv) is appointed every two years.
43
(4) (a) When a vacancy occurs in the membership for any reason, the replacement shall
44
be appointed for the unexpired term.

(b) If an elected official of a political subdivision or a director of a state agency that is
46
appointed by the governor in accordance with Subsection (2)(a)(iv) ceases to serve in that
47
individual's official capacity, a vacancy occurs and the governor shall appoint a new voting
48
member of the committee to fill the vacancy in accordance with Subsection (2)(a)(iv).

(5) (a) [Seven] Nine voting members of the committee constitute a quorum.
50
(b) One member from the Senate and one member from the House of Representatives shall
51
serve as cochairs of the committee.
52
(c) In conducting all its business, the committee shall comply with the rules of legislative
53
interim committees unless those rules conflict with this section.

(6) (a) (i) Members who are not government employees receive no compensation or
55
benefits for their services, but may receive per diem and expenses incurred in the performance of
56
the member's official duties at the rates established by the Division of Finance under Sections
57
63A-3-106
and
63A-3-107
.

(ii) Members may decline to receive per diem and expenses for their service.

(b) (i) State government officer and employee members who do not receive salary, per
60
diem, or expenses from their agency for their service may receive per diem and expenses incurred
61
in the performance of their official duties from the committee at the rates established by the
62
Division of Finance under Sections
63A-3-106
and
63A-3-107
.
63
(ii) State government officer and employee members may decline to receive per diem and
64
expenses for their service.

(c) Legislators on the committee receive compensation and expenses as provided by law
66
and legislative rule.

(d) (i) Local government members who do not receive salary, per diem, or expenses from
68
the entity that they represent for their service may receive per diem and expenses incurred in the
69
performance of their official duties at the rates established by the Division of Finance under
70
Sections
63A-3-106
and
63A-3-107
.

(ii) Local government members may decline to receive per diem and expenses for their
72
service.

(7) The Office of Legislative Research and General Counsel shall provide staff services
74
to the committee.

(8) The committee shall:
76
(a) recommend to the Legislature and to the governor:
77
(i) an ongoing and comprehensive strategic planning process for Utah; and
78
(ii) methods to improve productivity, efficiency, and customer service in governments in
79
Utah;
80
(b) to the greatest extent possible, involve all segments of Utah society including state and
81
local government, private industry, minority and ethnic groups, and all geographic areas of the
82
state in that process;
83
(c) undertake other activities related to strategic planning that the committee considers
84
necessary; and
85
(d) work with other public and private entities engaged in statewide strategic planning
86
efforts to coordinate their efforts with those of the committee.
