AN ACT RELATING TO STATE OFFICERS AND EMPLOYEES; MODIFYING

EXCEPTIONS TO PUBLIC OFFICERS AND PUBLIC EMPLOYEES PARTICIPATION IN

TRANSACTIONS; AND MAKING TECHNICAL CORRECTIONS.

This act affects sections of Utah Code Annotated 1953 as follows:

67-16-8, as last amended by Chapter 93, Laws of Utah 1990

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
67-16-8
is amended to read:

67-16-8. Participation in transaction involving business as to which public officer or
15
employee has interest -- Exceptions.

[(1) No] A public officer or public employee [shall] may not participate in his official
17
capacity or receive compensation [in respect to] for any transaction between the state or any of its
18
agencies and any business entity [as to] for which [such] the public officer or public employee is
19
also an officer, director, or employee or owns a substantial interest, unless disclosure has been
20
made as provided under Section
67-16-7
.

[(2) A concession contract between an agency, political subdivision, or the state and a
22
certified professional golf association member who is a public employee or officer does not violate
23
the provisions of Subsection (1) or Title 10, Chapter 3, Part 13.]
