AN ACT RELATING TO RETIREMENT; AMENDING INSURANCE BENEFIT PROVISIONS

FOR CERTAIN PEACE OFFICERS' SURVIVORS.

This act affects sections of Utah Code Annotated 1953 as follows:

49-8-405, as last amended by Chapter 282, Laws of Utah 1998

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
49-8-405
is amended to read:
13
49-8-405. Insurance benefits for peace officers' beneficiaries.

(1) As used in this section:
15
(a) "Children" includes stepchildren and legally adopted children.
16
(b) "Line of duty death" means a death resulting from external force or violence
17
occasioned by an act of duty as a peace officer.

[(1)] (2) The beneficiary of a peace officer under Title 53, Chapter 13, Peace Officer
19
Classifications, who is employed by the state and who dies in the line of duty [as defined under
20
Subsection (3),] shall receive:
21
(a) the proceeds of a group term life insurance policy in the amount of $50,000 to be
22
purchased by the division and paid for by the employing unit[.]; and
23
(b) a group health insurance policy paid for by the employing unit that covers the peace
24
officer's:
25
(i) surviving spouse until remarriage; and
26
(ii) unmarried children up to the age of 26.

[(2)] (3) Any political subdivision which employs a peace officer under Title 53, Chapter
28
13, Peace Officer Classifications, may provide the benefit under Subsection [(1)] (2).

[(3) "Line of duty death" means a death resulting from external force or violence
30
occasioned by an act of duty as a peace officer.]
