AN ACT RELATING TO HEALTH; REQUIRING THE DEPARTMENT OF HEALTH TO

SUBMIT A WAIVER REGARDING THE MEDICAID FRAUD CONTROL UNIT AND TO

REPORT ON THE STATUS OF THE WAIVER TO THE LEGISLATURE.

This act affects sections of Utah Code Annotated 1953 as follows:

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
26-18-403
is enacted to read:

26-18-403. Medicaid Fraud Control Unit Waiver.

(1) Before July 1, 2000, the department shall submit an application to the Secretary of the
15
United States Department of Health and Human Services that demonstrates, pursuant to 42 U.S.C.
16
Sec. 1396a:
17
(a) that the requirement of a Medicaid fraud control unit should be waived; and
18
(b) how the state will pursue fraud and patient abuse cases in the absence of a unit.
19
(2) The department shall report to the Health and Human Services Interim Committee
20
regarding the status and content of the waiver application at the following times:
21
(a) on or before June 1, 2000;
22
(b) on or before November 30, 2000; and
23
(c) upon the request of the committee.
24
(3) The Medicaid Fraud Control Unit shall be discontinued upon the federal approval of
25
the state's waiver application.
