Mr. President:

    The Judiciary Committee reports a favorable recommendation on S.B. 166, GRANDPARENTS VISITATION RIGHTS, by Senator T. Spencer, with the following amendments:
1.    Page 1, Line 6:    Delete "AND"

2.    Page 1, Line 7:    After "DECISION" insert "; MODIFYING THE DEFINITION OF GRANDPARENT; AND MAKING CERTAIN PROVISIONS FOR STEPPARENT ADOPTIONS"

3.    Page 1, Line 9:    After line 9 insert:
        " 30-5-1 as last amended by Chapter 175, Laws of Utah 1992"

4.    Page 1, Line 11:    After line 11, insert:
        "Section 1. Section 30-5-1 is amended to read:
         30-5-1. Definitions.
        As used in this act:
        (1) "District court" means the district court within whose jurisdiction the grandchildren reside.
        (2) "Grandchildren" means the child or children that a grandparent is seeking visitation rights with under this chapter.
        (3) "Grandparent" means a person whose child , either by blood, marriage, or adoption, is the parent of the grandchildren."

5.    Page 2, Line 34:    After "rights of a" bracket "biological"




6.    Page 2, Line 35:    After "section." insert " Nothing in this Subsection (4) affects the rights of a grandparent established pursuant to the provisions of this section, if the child is adopted by a stepparent. "

         Renumber remaining section accordingly.
