INSURANCE COMPANIES NOTIFICATION IN DIVORCE SITUATIONS

House Floor Amendments

Representative Gladwell proposes the following amendments:

1.    Page 1, Line 8:    After "COVERAGE" insert "; AND PROVIDING AN EFFECTIVE DATE"

2.    Page 2, Lines 38-47
    House Committee Amendments
    1-28-2000:    Delete lines 38 through 47 and insert:
        "(c) An insurer may satisfy the requirement of Subsection (4)(b) by sending the same notice of commencement or termination of insurance to the last-known address of the child as is sent to the insured parent.
        (d) An insurer who fails to provide the notice required by this Subsection (4) may not be held civilly liable by the person to whom the notice was to be sent, but shall be subject to Chapter 2, Part 3, Procedures and Enforcement."

3.    Page 3, Line 117:    After line 117 insert:
        "Section 2. Effective date.
        This act takes effect on October 1, 2000."
