             6      This act modifies the offenses against the family section of the Utah Criminal Code. The
             7      act prohibits the state and political subdivisions from using public funds for the
             8      performance of an abortion, and provides a penalty.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:
             11          76-7-326, Utah Code Annotated 1953
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 76-7-326 is enacted to read:
             14          76-7-326. Public funding of abortion forbidden.
             15          (1) Public funds of the state, its institutions, or its political subdivisions may not be
             16      used to pay or otherwise reimburse, either directly or indirectly, any person, agency, or facility
             17      for the performance of any induced abortion service, except as authorized under h [ Subsection ]
             17a      SUBSECTIONS h
             18      76-7-302 (2)(a) h ,(b), OR (c) h .
             19          (2) If a state agency violates Subsection (1), the Legislature h [ shall ] MAY h eliminate
             19a      h [ all ] ANY OR ALL OF h the
             20      public funds provided to the state agency.
             20a           h (3) ANY AGENT OF A STATE AGENCY OR POLITICAL SUBDIVISION, ACTING ALONE OR IN
             20b      CONCERT WITH OTHERS WHO AUTHORIZE THE USE OF FUNDS PROHIBITED IN SUBSECTION (1) IS
             20c      GUILTY OF A CLASS B MISDEMEANOR AND SHALL BE TERMINATED FROM EMPLOYMENT. h
