6 This act modifies the Motor Vehicles Code by adding restrictions to parking a vehicle for
7 the purpose of displaying the vehicle for sale. This act prohibits a person from displaying
8 a vehicle for sale on a parking lot, vacant lot, or public right-of-way unless the seller is
9 the owner of the property or obtains the written consent of the owner. This act provides
10 written consent requirements. This act provides that a violation is a class C
11 misdemeanor.
12 This act affects sections of Utah Code Annotated 1953 as follows:
13 ENACTS:
14 41-6-116.30, Utah Code Annotated 1953
15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 41-6-116.30 is enacted to read:
17 41-6-116.30. Parking a vehicle for display for sale -- Restrictions -- Exceptions --
18 Consent of property owner -- Penalties.
19 (1) Except as provided under this section, a person may not park a vehicle for the
20 S SOLE s purpose of displaying the vehicle for sale or lease on:
21 (a) a parking lot;
22 (b) a vacant lot; or
23 (c) an improved or unimproved portion of a public right-of-way.
24 (2) Subsection (1) does not apply if:
25 (a) the activity is authorized by applicable zoning regulations; and
26 (b) the person:
27 (i) is the owner or person in lawful possession or control of the property on which the
28
29 (ii) has written consent of the property owner and posts the written consent inside the
30 windshield of the vehicle.
31 (3) A written consent under Subsection (2)(b)(ii) shall:
32 (a) be signed by the owner or person in lawful possession or control of the property;
33 (b) contain the name and address of the owner or person in lawful possession or control
34 of the property;
35 (c) contain the name and address of the registered owner of the vehicle; and
36 (d) state the period of time for which the vehicle is authorized to be parked on the
37 property.
38 (4) This section does not prevent a person from parking a vehicle on a public
39 right-of-way immediately adjacent to the property that is owned or in lawful possession or
40 control of the person parking the vehicle.
41 (5) A person who violates the provisions of this section is guilty of a class C
42 misdemeanor.
