This act modifies provisions relating to county planetariums. The act provides for the
6
appointment of other planetarium personnel by the county executive rather than the
7
county legislative body. The act also makes technical changes.

This act affects sections of Utah Code Annotated 1953 as follows:

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
17-37-8
is amended to read:

17-37-8. Director to be appointed -- Duties and compensation -- Other personnel.

[The] (1) (a) Subject to Subsection (1)(b), the county executive[, with the advice and
15
consent of the county legislative body,] shall appoint a competent person as planetarium
16
director to have immediate charge of:
17
(i) planetarium facilities and activities not contracted to an outside entity[,]; and [of]
18
(ii) overseeing the performance of the terms of any contract or lease entered into with a
19
contracting entity.

(b) In a county with a form of government that has a county executive that is separate
21
from the county legislative body, the appointment under Subsection (1)(a) shall be with the
22
advice and consent of the county legislative body.

(2) The planetarium director shall:
24
(a) have such duties and receive such compensation for [his or her] the director's
25
services as the county executive shall determine[. The planetarium director shall]; and
26
(b) act as the executive officer for the planetarium board and [shall] implement the
27
policies of the board.

(3) (a) The county [legislative body shall] executive may appoint, upon the
29
recommendation of the planetarium director, other planetarium personnel [as required;
30
however, any].

(b) Each county [employees] employee working at the planetarium shall be subject to
32
the provisions of [the] Chapter 33, County Personnel Management Act, and other general laws
33
[as] relating to county personnel matters [that are applicable to counties].
