Senator Carlene M. Walker proposes the following amendments:

1.    Page 1, Line 9
    Senate Committee Amendments,
    2-21-2003:    After " assessment." insert " The act limits the use of funds from an assessment for a special improvement district for cable television and telecommunications facilities and prohibits nondistrict municipal funds from being used for those facilities."

2.    Page 3, Line 72
    Senate Committee Amendments,
    2-21-2003:    After "(5)" insert "(a)" and after "Subsection (1)(p):" delete "(a)" and insert "(i)"

3.    Page 3, Line 74a
    Senate Committee Amendments,
    2-21-2003:    At the beginning of line 74a delete "(b)" and insert "(ii)"

4.    Page 3, Line 74c
    Senate Committee Amendments,
    2-21-2003:    After line 74c insert:

        "(b) Notwithstanding any other provision of law, a municipality that creates a district to make the improvements set forth in Subsection (1)(p) may not use municipal funds, other than those derived from an assessment levied under this part on property within that district, to pay for those improvements.
        (c) Notwithstanding any other provision of this part, funds derived from an assessment levied under this part on property within a district created to make the improvements set forth in Subsection (1)(p) may be used only for the purpose of making those improvements."
