7 General Description:
8 This bill creates the Adoption Agency Fees Task Force.
9 Highlighted Provisions:
10 This bill:
11 . establishes a legislative task force to study fees associated with private adoptions;
12 . establishes task force membership, duties, and salaries and designates staff for the
13 task force;
14 . requires the task force to prepare a report; and
15 . requires the task force to report its findings to the Health and Human Services
16 Interim Committee before November 2004.
17 Monies Appropriated in this Bill:
18 This bill appropriates:
19 . $3,500 to the Senate;
20 . $3,500 to the House of Representatives; and
21 . $25,000 to the Office of Legislative Research and General Counsel.
22 Other Special Clauses:
23 This bill is repealed on November 30, 2004.

27 Be it enacted by the Legislature of the state of Utah:
28 Section 1. Adoption Agency Fees Task Force -- Creation -- Membership -- Interim
29 rules followed -- Compensation -- Staff.
30 (1) There is created the Adoption Agency Fees Task Force consisting of the following
32 (a) three members of the Senate appointed by the president of the Senate, no more than
33 two of whom may be from the same political party; and
34 (b) three members of the House of Representatives appointed by the speaker of the
35 House of Representatives, no more than two of whom may be from the same political party.
36 (2) (a) The president of the Senate shall designate a member of the Senate appointed
37 under Subsection (1)(a) as a cochair of the task force.
38 (b) The speaker of the House of Representatives shall designate a member of the House
39 of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
40 (3) In conducting its business, the task force shall comply with the rules of legislative
41 interim committees.
42 (4) Salaries and expenses of the members of the task force shall be paid in accordance
43 with Section 36-2-2 and Legislative Joint Rule 15.03.
44 (5) The Office of Legislative Research and General Counsel shall provide staff support
45 to the task force.
46 Section 2. Duties -- Interim report.
47 (1) The task force shall review and make recommendations on adoption fees and costs
48 charged by adoption agencies and attorneys in private adoptions including an accounting of:
49 (a) consideration paid to birth mothers in adoption situations;
50 (b) consideration paid to legal and other professionals in adoption situations; and
51 (c) Medicaid funds used to cover delivery expenses.
52 (2) The task force shall review and make recommendations regarding the information
53 collected on residence of parties in private adoptions, including:
54 (a) the state or country the birth mother is a resident of; and
55 (b) the state or country of which the adoptive parent or parents are residents.
56 (3) A final report, including any proposed legislation shall be presented to the Health
57 and Human Services Interim Committee before November 30, 2004.
58 Section 3. Appropriation.
59 There is appropriated from the General Fund for fiscal year 2003-04 only:
60 (1) $3,500 to the Senate to pay for the compensation and expenses of senators on the
61 task force;
62 (2) $3,500 to the House of Representatives to pay for the compensation and expenses
63 of representatives on the task force; and
64 (3) $25,000 to the Office of Legislative Research and General Counsel to pay for
65 staffing the task force.
66 Section 4. Repeal date.
67 This bill is repealed on November 30, 2004.
