Rep. Mascaro called the meeting to order at 8:10 a.m.

MOTION:    Rep. Buffmire moved to approve the minutes of the January 23, 2004 meeting. The motion passed unanimously.


H.B. 198    Child Welfare Court Reports (Rep. M. Thompson

MOTION:    Rep. Buffmire moved to delete H.B. 198 in title and body and replace it with 2nd Substitute H.B. 198. The motion passed unanimously.

Rep. Thompson introduced 2nd Sub. H.B. 198 and explained it to the committee.

Spoke in favor of the bill:    Richard Anderson, Division of Child and Family Services
            Mark May, Attorney General's Office

MOTION:    Rep. Litvack moved to pass the substitute bill out favorably. The motion passed unanimously.


H.B. 60    Protection of Children in Foster Care (Rep. D. Litvack)

Rep. Litvack introduced H.B. 60 and explained it to the committee.



MOTION:    Rep. Thompson moved to amend the bill as follows:

1.    Page 4, Lines 109 through 110 :    

             109      appointed by a court to represent the interests of the children.
  The access granted to the Office of the Guardian Ad Litem is limited to information entered into the system on or after July 1, 2004, except the Office may have access to all child abuse and neglect referrals.      

             110          (b) Each contract provider and designated representative of the Office of the Guardian

The motion to amend the bill passed unanimously.

Rep. Seitz introduced H.B. 174 and explained it to the committee.

MOTION:    Rep. Last moved to amend the bill as follows:

Page 2, Line 39:    After "mentally ill or" insert "guilty and mentally ill at the time of the offense"
Page 2, Line 43:    After "mentally ill or" insert "guilty and mentally ill at the time of the offense"
Page 2, Line 44:    Delete "are also mentally retarded" insert "also have mental retardation"
Page 2, Line 45:    After "persons" insert "undergoing evaluation for competency or

The motion to amend the bill passed unanimously.

MOTION:    Rep. Thompson moved to pass the amended bill out favorably. The motion passed unanimously.




H.B. 200    Recognition of Foreign Adoptions (Rep. W. Harper)

MOTION:    Rep. Thompson moved to delete in title and body H.B. 200 and replace it with 1st Substitute H.B. 200. The motion passed unanimously.

Rep. Harper introduced 1st Sub. H.B. 200 and explained it to the committee.

MOTION:    Rep. Litvack moved to pass the substitute bill out favorably. The motion passed unanimously.
