     Vice Chair Wallace called the meeting to order at 8:07 a.m.

MOTION:    Rep. Shurtliff moved to approve the minutes of February 3, 2004. The motion         passed unanimously with, Rep. Love, Rep. Morgan, and Rep.Cox absent for the         vote.


H.B. 238    Workers' Compensation Access to Medical Records (Rep. J. Alexander)

    Rep. Alexander introduced H.B. 238 and explained it to the committee. He was assisted by Joyce A. Sewell, Director, Industrial Accidents Division, Labor Commission.

MOTION:    Rep. Mascaro moved to amend the bill as follows:

1.    Page 4, Lines 110 through 115 :    

             110          (9) (a) Except as provided in Subsection (9)(c), a physician attending an injured
             111      employee shall[: (i)] comply with [all the] rules[, including the schedule of] established by the
             112      commission regarding:
             113          (i) fees[,] for [the] physician's services [as adopted by the commission; and


(ii) make];
             114          (ii) disclosure of medical records of the employee
  medically       relevant to the employee's industrial

             115      accident, or occupational disease claim; and

        The motion passed unanimously with Rep. Love and Rep. Morgan absent for the         vote.

MOTION:    Rep. Alexander moved to amend the bill as follows:

2.    Page 2, Lines 37 through 39 :    

             37          (c) An employee claiming benefits under this chapter, or Chapter 3, Utah Occupational
             38      Disease Act, shall comply with rules adopted by the commission regarding disclosure of
             39      medical records of the employee
  medically       relevant to the industrial        accident       or occupational disease claim.


        The motion passed unanimously with Rep. Love and Rep. Morgan absent for the         vote.

MOTION:    Rep. Shurtliff moved to pass the bill out favorably as amended. The              motion passed unanimously with Rep. Love absent for the vote.

H.B. 256    Expansion of Economic Development Webpage (Rep. S. Allen)

    Rep. Barras introduced H.B. 256 and explained it to the committee. Rep. Allen, sponsor, commented on the bill.

MOTION:    Rep. Morgan moved to amend the bill as follows:

1.    Page 4, Lines 100 through 102 :    

             100          (v) Department of Administrative Services - Division of
  Purchasing and       General Services      [[   and   ]]

             101     
[[   Procurement   ]] , including other state agencies operating under a grant of authority from the

             102      division to procure goods and services in excess of $5,000;

        The motion passed unanimously with Rep. Alexander, Rep. Love, and
        Rep. Wallace absent for the vote.

MOTION:    Rep. Mascaro moved to pass the bill out favorably as amended. The motion         passed unanimously with Rep. Alexander, Rep. Love, and Rep.Wallace absent         for the vote.

S.B. 5    Employment Security Modifications (Sen. S. Jenkins)

    Sen. Jenkins introduced S.B. 5 and explained it to the committee. He was assisted by Sarah Brenna, Department of Workforce Services.

MOTION:    Rep. Morgan moved to pass the bill out favorably. The motion passed              unanimously with Rep. Alexander absent for the vote.

MOTION:    Rep. Wallace moved to adjourn the meeting. The motion passed unanimously         with Rep. Alexander absent for the vote.
