proposes the following amendments:

(c) (i) Notwithstanding the requirements of Subsection (1)(b), the legislative body of a

local political subdivision may call a local special election on a date other than those specified

in this section if
:
(A)
the legislative body:

(I)
determines and declares that there is [an emergency] a disaster, as defined in

Section
63-5-2
, requiring that a special election be held on a date other than the ones

authorized in statute;

(B)
]]
(II)
identifies specifically the nature of the [emergency] disaster, as defined in Section

63-5-2
, and the reasons for holding the special election on that other date; and

(C)
]]
(III)
votes unanimously to hold the special election on that other date

; or
(B) (I) the local special election is for a referendum; and
(II) the subject of the referendum is a land use law as defined in Section 20A-7-601.
