determine which program best meets the educational needs of the student.
(5) In implementing and administering the No Child Left Behind Act, the State Board of
Education shall ensure that:
(a) student performance data is disaggregated with respect to race, ethnicity, gender, limited
English proficiency, and those students who qualify for free or reduced price school lunch in accordance
with Section 53A-1-603;
(b) each of the subgroups identified under Subsection (5)(a) that consists of 10 or more students is
separately accounted for in both assessment and accountability provisions; and
(c) the state's public education system complies with the requirements of the No Child Left Behind
Act sufficiently to:
(i) qualify to receive full federal funding; and
(ii) not jeopardize loss of federal funds due to non-compliance.
