LONG TITLE

General Description:

This bill modifies the Transportation Code by amending provisions relating to trucks
10
being operated on Legacy Parkway.

Highlighted Provisions:

This bill:

. provides definitions;
14
. requires the department to restrict certain trucks from being operated on the Legacy
15
Parkway except in certain circumstances; and
16
. repeals the provision that requires the department to restrict certain trucks from
17
being operated on the Legacy Parkway on January 1, 2020.

Be it enacted by the Legislature of the state of Utah:

72-3-113. Truck limitations on Legacy Parkway.

(1) As used in this section:
35
(a) "Legacy Parkway" means the proposed or existing four-lane limited access highway
36
that runs approximately 14 miles from I-215 in Salt Lake County to US 89 in Davis County.
37
(b) (i) "Reconstruction of I-15 between US 89 in Farmington and I-215 in North Salt
38
Lake City" means the physical construction work necessary to add capacity to the portion of
39
I-15 from I-215 in Davis County to the interchanges with US 89 and I-15 in Farmington.

(ii) "Reconstruction of I-15 between US 89 in Farmington and I-215 in North Salt Lake
41
City" does not include:
42
(A) preparation of environmental impact statements;
43
(B) preliminary design work or repairs; and
44
(C) maintenance and operations of the highway that do not add capacity to the
45
highway.

(c) (i) "Truck" means any vehicle:
47
(A) with five or more axles; or
48
(B) of 80,000 pounds or greater registered gross vehicle weight.
49
(ii) "Truck" does not include:
50
(A) equipment owned and operated by the United States Department of Defense when
51
driven by any active duty military personnel and members of the reserves and National Guard
52
on active duty including:
53
(I) personnel on full-time National Guard duty;
54
(II) personnel on part-time training;
55
(III) National Guard military technicians; and
56
(IV) civilians who are required to wear military uniforms and are subject to the Code of
57
Military Justice;
58
(B) authorized emergency vehicles as defined in Section
41-6a-102
operated by
59
emergency personnel but not including commercial tow trucks; or
60
(C) recreational vehicles that are driven solely as family or personal conveyances for
61
noncommercial purposes.

(2) The Legislature finds and declares that the limitation of trucks being operated on
63
the Legacy Parkway under Subsection (3) is due to the unique location of the Legacy Parkway,
64
which is adjacent to the Legacy Nature Preserve.

(3) The department shall restrict trucks from being operated on the Legacy Parkway
66
provided that:
67
(a) trucks shall be allowed to be operated on the Legacy Parkway during reconstruction
68
of I-15 between US 89 in Farmington and I-215 in North Salt Lake City; and
69
(b) trucks shall be allowed to be operated on the Legacy Parkway if diversion of traffic
70
from I-15 or another route is determined to be necessary by the highway patrol and the
71
department in the event of an incident, following standard procedures for protecting public
72
safety.
