General Description:

This bill addresses issues related to the 17th Amendment to the United States
18
Constitution, modifies the Election Code to provide notice to political parties regarding
19
optional procedures for nomination of candidates, and modifies the title on the
20
Legislature to allow the Legislature to give direction to certain United States Senators
21
and receive certain reports from them.

Highlighted Provisions:

This bill:

. notifies political parties that they may submit the names of candidates for review
25
and selection by members of the Legislature in the same party;
26
. allows the Legislature to give direction to a United States Senator elected from
27
Utah;
28
. allows the Legislature to require a United States Senator elected from Utah to report
29
to the Legislature on certain issues determined by the Legislature; and
30
. provides that any direction or reporting requirements shall be made by a joint
31
resolution of the Legislature.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
20A-8-405
is enacted to read:

20A-8-405. Option for submission of party candidates for the United States
44
Senate to the Legislature.

(1) A political party may elect to include a provision in its bylaws that permits the
46
political party to submit the names of two recommended candidates for the office of United
47
States Senator to those members of the Legislature that are members of the political party.
48
(2) The provision in the political party's bylaws may permit those members of the
49
Legislature that are members of the political party to select, by a majority vote, one of the two
50
candidates submitted under Subsection (1) to be the party's candidate for the office of United
51
States Senator.

Section 2.

36-26-101
is enacted to read:

36-26-101. Legislature's direction to U.S. Senators -- Reporting.

(1) The Legislature may give direction to a United States Senator elected from Utah.
55
(2) The Legislature may require a United States Senator elected from Utah to provide a
56
single report or periodic reports to the Legislature on:
57
(a) the senator's progress with the direction given under Subsection (1); or
58
(b) other issues as determined by the Legislature.

(3) The Legislature shall provide any direction or reporting requirements under
60
Subsections (1) and (2) by passing a joint resolution of the Legislature.
61
(4) The Office of Legislative Research and General Counsel shall maintain a record of:
62
(a) all resolutions passed under this section; and
63
(b) all reports issued to the Legislature by a United States Senator in response to a
64
resolution passed under this section.
