General Description:

This concurrent resolution of the Legislature and the Governor strongly opposes the
11
transportation to and storage of spent nuclear fuel at Skull Valley, Utah.

Highlighted Provisions:

This resolution:
14
. strongly opposes the transportation to and storage of spent nuclear fuel at Skull
15
Valley;
16
. declares the unacceptable risk to the health and safety of the citizens of Utah of
17
transporting spent nuclear fuel on the Skull Valley Road; and
18
. urges the citizens of Utah to provide comment to the Bureau of Land Management
19
by telephone, e-mail, and mail expressing opposition to Private Fuel Storage's
20
application to use Bureau of Land Management land for the construction and
21
operation of the proposed Private Fuel Storage intermodal transfer facility.

Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
26
WHEREAS, Private Fuel Storage has received a license from the Nuclear Regulatory
27
Commission to store up to 44,000 tons of spent nuclear fuel in 4,000 casks at the Skull Valley
28
Indian Reservation in Tooele County, Utah;
29
WHEREAS, under the Private Fuel Storage license, the only remaining viable route to
30
transport the spent nuclear fuel casks from the main railroad line at Rowley Junction to the
31
Skull Valley Reservation is to transport the casks by truck from a proposed Private Fuel
32
Storage intermodal transfer facility to be located on public land owned by the Bureau of Land
33
Management (BLM) using the Skull Valley Road;
34
WHEREAS, Private Fuel Storage has made an application to the BLM for a permit to
35
use BLM public land for its proposed intermodal transfer facility; and
36
WHEREAS, the BLM has authorized a 90-day public comment period that will expire
37
on May 8, 2006, to receive public comment on Private Fuel Storage's application to use BLM
38
land for Private Fuel Storage's proposed intermodal transfer facility:

NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
40
Governor concurring therein, strongly oppose the use of public lands owned by the BLM to
41
facilitate the transfer and storage of spent nuclear fuel.

BE IT FURTHER RESOLVED that the Legislature and the Governor declare that the
43
transport of spent nuclear fuel on public roads is wholly impractical, and that the transport and
44
operation of the proposed intermodal transfer facility present an unacceptable risk to the health
45
and safety of the citizens of Utah.

BE IT FURTHER RESOLVED that the Legislature and the Governor strongly urge the
47
citizens of Utah to take advantage of the opportunity to comment by telephone (Pam Schuller
48
at 1-801-977-4356), e-mail, and mail (Bureau of Land Management, Attention Pam Schuller,
49
Salt Lake Field Office, 2370 South 2300 West, Salt Lake City, Utah 84119), expressing their
50
opposition to Private Fuel Storage's application to use BLM land for the construction and
51
operation of the proposed Private Fuel Storage intermodal transfer facility.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Bureau of
53
Land Management, The Tribal Executive Committee of the Skull Valley Band of Goshute
54
Indians, the Nuclear Regulatory Commission, and Private Fuel Storage.
