Chair S. Clark called the meeting to order at 2:17 p.m.

H.B. 29    Professional Employer Organization Related Amendments
        (Rep. J. Dunnigan)

Rep. Dunnigan introduced the bill to the committee with the assistance of Bill Pendleton, Chair, Utah Leadership Council , National Association of Professional Employer Organizations.

MOTION:    Rep. Ferry moved to delete in title and body H.B. 29 and replace it with 1st Substitute H.B. 29. The motion passed unanimously, with Rep. Morley absent for the vote.

MOTION:    Rep. Kiser moved to pass the bill out favorably. The motion passed unanimously.



H.B. 80    Health Insurance Amendments (Rep. J. Dunnigan)

Rep. Dunnigan introduced the bill to the committee with the assistance of Tomi Ossana, Executive Director, Health Insurance Pool of Utah.

MOTION:    Rep. Dunnigan moved to amend the bill as follows:


1.    Page 8, Lines 217 through 218 :    

             217          (1) (a) Except as provided in
{   Subsections   }        Subsection       (1)(b)      {   and (2)   } , an individual who is not

             218      HIPAA eligible is eligible for pool coverage if the individual:

2.    Page 9, Lines 250 through 251 :    

             250          (2) (a) Except as provided in
{   Subsections   }        Subsection            {   (1) and   } (2)(b), an individual who is HIPAA

             251      eligible is eligible for pool coverage if the individual:

3.    Page 9, Lines 254 through 255 :    

             254          (b) Notwithstanding
{   Subsections   }        Subsection            {   (1) and   } (2)(a), a HIPAA eligible individual is not

             255      eligible for pool coverage if one or more of the following conditions apply:

MOTION:    Rep. Kiser moved to pass the bill out favorably as amended.

SUBSTITUTE
MOTION:    Rep. D. Clark moved to pass the bill out favorably and amend the bill as follows:

1.    Page 12, Lines 348 through 350 :    

             348          (10) Covered benefits available from the pool may not exceed a [$1,000,000]
             349     
{   $2,000,000   }        $1,500,000       lifetime maximum, which includes a per enrollee calendar year maximum

             350      established by the board.

The substitute motion to amend and pass the bill out favorably passed, with Rep. Kiser voting in opposition.


Chair S. Clark relinquished the chair to Vice Chair Dunnigan.

H.B. 64    Impact of Administrative Rules on Small Businesses (Rep. S. Clark)

Rep. S. Clark introduced the bill to the committee with the assistance of Ken Hansen, Director, Division of Administrative Rules.

MOTION:    Rep. Garn moved to pass the bill out favorably. The motion passed unanimously.

MOTION:    Rep. Morley moved to adjourn the meeting. The motion passed unanimously.

Vice Chair Dunnigan adjourned the meeting at 3:30 p.m.
