Rep. Ray called the meeting to order at 2:24 p.m. Committee members and staff were introduced.

H.B. 84    Traumatic Brain Injury Fund (Rep. J. Gowans)

MOTION:    Rep. Menlove moved to amend H.B. 84 as follows:

1.    Page 4, Line 95 through Page 5, Line 128 :    

             95          62A-16-202. Traumatic Brain Injury Board.
             96          (1) There is created within the Department of Human Services, the Traumatic Brain
             97      Injury Board.

             120          (5) Not later than November 30 of each year, the board shall:
             121          (a) provide a written report to:
             122          (i) the executive director of the department;
{   and   }

             123          (ii) the Health and Human Services Interim Committee;
  and

    (iii) the Health and Human Services Appropriations Subcommittee;  
and

             124          (b) summarize the activities of the board and identify each disbursement from the fund
             125      and its purposes in the report.
             126          (6) The board shall reimburse the Administrative Office of the Courts from the fund
{   an   }        a one-time only      

             127      amount not to exceed $20,000 for costs associated with the collection and distribution of the
             128      surcharge amounts. Reimbursement shall occur as soon as funds are available.

The motion to amend the bill passed unanimously with Rep. Harper and Rep. Sandstrom absent for the vote.

Rep. Gowans introduced H.B. 84 as amended and explained it to the committee. Handouts were provided to committee members.

MOTION:    Rep. Litvack moved to pass H.B. 84 as amended out favorably. The motion passed with Rep. Harper voting in opposition to the motion and Rep. Dougall absent for the vote.

H.B. 47    Pilot Program for Family Preservation Services (Rep. R. Menlove)

Rep. Menlove introduced H.B. 47 and explained it to the committee, assisted by Dr. George Kelner, Division of Services to People with Disabilities.

                        Dr. Susan Macnamara, Division of Services to People with                         Disabilities

MOTION:    Rep. Litvack moved to pass H.B. 47 out favorably. The motion passed unanimously with Rep. Dougall and Rep. Harper absent for the vote.

H.B. 51    Adoption Amendments (Rep. S. Allen)

MOTION:    Rep. Litvack moved to amend H.B. 51 as follows:

1.    Page 3, Line 78 through Page 4, Line 90 :    

             78          (ii)
  subject to Subsection (3),       the criminal history check described in Subsection (1)(b)(ii)(B) shall be submitted

             79      in a manner acceptable to the court that will:
             80          (A) preserve the chain of custody of the results; and
             81          (B) not permit tampering with the results by a prospective adoptive parent or other
             82      interested party; and

             83          (b) if the adoption is being handled by a private attorney, and not a human services
             84      program, the criminal history checks described in Subsection (1)(b)(ii), shall be:
             85          (i) submitted in accordance with procedures established by the Criminal Investigations
             86      and Technical Services Division of the Department of Public Safety; or
             87          (ii)
  subject to Subsection (3),       submitted in a manner acceptable to the court that will:

             88          (A) preserve the chain of custody of the results; and
             89          (B) not permit tampering with the results by a prospective adoptive parent or other
             90      interested party.
  (3)    In order to comply with Subsection (2)(a)(ii) or (b)(ii), the manner in which the criminal history check is submitted shall be approved by the court.      


The motion to amend the bill passed unanimously.

Rep. Allen introduced H.B. 51 as amended and explained it to the committee, assisted by Larry Jenkins, Utah Adoption Council. A handout explaining the bill was provided to committee members.

MOTION:    Rep. Buxton moved to pass the amended bill out favorably. The motion passed unanimously.

H.B. 57    Public Health Amendments (Rep. B. Last)

Rep. Last introduced H.B. 57 and explained it to the committee, assisted by Doug Springmeyer, Attorney General's Office.

MOTION:    Rep. Buxton moved to pass H.B. 57 out favorably. The motion passed unanimously with Rep. Sandstrom absent for the vote.

MOTION:    Rep. Riesen moved to adjourn the meeting. The motion passed unanimously with Rep. Sandstrom absent for the vote.

Rep. Ray adjourned the meeting at 4:08 p.m.
